Florida Consumer Protection Law: Florida Deceptive and Unfair Trade Practices Act (FDUTPA)

Florida's FDUTPA (Fla. Stat. §§ 501.201-501.213) prohibits unfair methods of competition and unfair or deceptive acts or practices in the conduct of any trade or commerce. FDUTPA provides consumers with a private right of action for actual damages, attorney fees, and court costs. Florida also has strong debt collection protections under the Florida Consumer Collection Practices Act (FCCPA, Fla. Stat. § 559.55 et seq.), which applies to original creditors as well as third-party collectors — broader than the federal FDCPA.
