New York Consumer Protection Law: New York General Business Law §§ 349 and 350

New York GBL § 349 prohibits deceptive acts or practices in the conduct of any business, trade, or commerce in New York State. GBL § 350 prohibits false advertising. Both statutes provide consumers with a private right of action for actual damages or $50 (whichever is greater), plus attorney fees. For willful violations, courts may award up to three times actual damages (maximum $1,000 under § 349). New York Rule 7.1 requires 'Attorney Advertising' on all attorney communications and that any specialization claims include a source disclaimer in a font at least two sizes larger than the body text.
