Kentucky Consumer Protection Law: Kentucky Consumer Protection Act (KCPA)

The Kentucky Consumer Protection Act (KRS §§ 367.110-367.300) prohibits unfair, false, misleading, or deceptive acts or practices in the conduct of any trade or commerce. The KCPA provides consumers with a private right of action for actual damages or $25 (whichever is greater), plus attorney fees and court costs. Kentucky also has specific rules governing attorney advertising under SCR 3.130(7.1) et seq.
