The Texas DTPA (Tex. Bus. & Com. Code §§ 17.41-17.63) is one of the most powerful consumer protection statutes in the country. It prohibits false, misleading, or deceptive acts or practices in the conduct of any trade or commerce. The DTPA provides for actual damages, and for knowing violations, up to three times actual damages. The statute also provides for attorney fees. Texas Rule 7.01(g) requires that if a dollar figure is shown in attorney advertising, the net-to-client amount must be shown with equal prominence.
